1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and CrushPress.ai (“CrushPress.ai,” “we,” “us,” or “our”) governing your access to and use of the CrushPress.ai website, platform, APIs, plugins, and all related products, services, and documentation (collectively, the “Service”). By accessing, installing, or using any component of the Service—including any CrushPress.ai plugin or integration—you acknowledge that you have read, understood, and agreed to these Terms. If you do not agree, you must immediately discontinue use and uninstall any plugin.

2. Description of Service

CrushPress.ai provides artificial-intelligence-powered schema optimization, middleware automation, and related analytics tools designed for WordPress and other web-building platforms. The Service may include integrations, plug-ins, dashboards, APIs, and machine-generated outputs. All components are provided strictly on an “as is,” “as available,” and “with all faults” basis, without warranties of any kind.

3. No Warranty and AI Output Disclaimer

All outputs, recommendations, or generated data from the Service are provided for informational and experimental purposes only. CrushPress.ai expressly disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, legality, or reliability. AI-generated data may be incomplete, inaccurate, biased, or otherwise unsuitable for public use. You assume full responsibility for reviewing and verifying all such outputs prior to use or publication.

4. Limitation of Liability

To the fullest extent permitted by law, CrushPress.ai and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, goodwill, or business interruption. In no event shall CrushPress.ai’s total aggregate liability exceed the greater of one hundred Canadian dollars (CAD $100) or the total amount paid by you in the twelve (12) months preceding the claim. Your sole and exclusive remedy is to discontinue use of the Service.

5. Indemnification

You agree to defend, indemnify, and hold harmless CrushPress.ai, its affiliates, officers, directors, employees, and contractors from and against all claims, damages, losses, or expenses (including reasonable legal fees) arising from your use or misuse of the Service, your breach of these Terms, or your violation of applicable law or third-party rights.

6. User Responsibilities

• Review and validate all outputs generated by the Service prior to publication or use;
• Ensure that your use complies with all applicable laws and third-party platform policies;
• Maintain security and confidentiality of all account credentials;
• Obtain all required consents prior to processing personal or regulated data through the Service; and
• Acknowledge that installation or activation of a CrushPress.ai plugin may automatically transmit certain limited site and account data necessary for core functionality, as detailed in Section 17 below.

7. Intellectual Property Rights

All intellectual property in the Service—including but not limited to code, design, branding, trademarks, documentation, and models—remains the sole property of CrushPress.ai and its licensors. You may not copy, modify, reverse engineer, or redistribute any part of the Service without prior written authorization.

8. Payments, Refunds, and Disputes

All fees and charges are non-refundable, except where required by law. By submitting payment information, you authorize CrushPress.ai or its payment processor to charge the applicable amount as described at the time of purchase. Chargebacks or disputes constitute a material breach of these Terms and may result in suspension or termination of access without liability.

9. Third-Party Services and Integrations

The Service may rely on or interoperate with third-party platforms and APIs (including, but not limited to, WordPress, HighLevel, Wix, Duda, Editor X, OpenAI, and Google). CrushPress.ai disclaims any liability for outages, policy changes, or damages resulting from these third-party dependencies. Use of any third-party service remains governed by that service’s own terms and policies.

10. Communications

By providing contact details, you authorize CrushPress.ai to send you transactional, service-related, and support communications via email, SMS, or other means. Promotional or marketing messages will be sent only with your express consent. You may withdraw such consent at any time. Standard carrier or data rates may apply.

11. Modifications, Suspension, and Termination

CrushPress.ai may modify, suspend, or discontinue the Service, or any component thereof, at any time and without notice. We may terminate or restrict access if we determine that you have violated these Terms, engaged in fraudulent activity, or created risk or exposure to CrushPress.ai. Upon termination, your right to use the Service immediately ceases.

12. Arbitration and Class-Action Waiver

All disputes arising from these Terms shall be resolved exclusively through binding arbitration in Toronto, Ontario, under the Arbitration Act (Ontario). You waive the right to a jury trial or to participate in any class, collective, or representative action. The arbitrator’s decision shall be final and enforceable in any court of competent jurisdiction.

13. Force Majeure

CrushPress.ai shall not be liable for any delay or failure to perform resulting from circumstances beyond its control, including but not limited to natural disasters, internet outages, strikes, government actions, or third-party service disruptions.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. Subject to Section 12, the courts of Toronto, Ontario shall have exclusive jurisdiction over any dispute not subject to arbitration.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect, interpreted to give effect to the parties’ original intent.

16. Amendments and Updates

CrushPress.ai may amend these Terms at any time by posting an updated version on its website or within its plugins. Continued use of the Service after such posting constitutes your binding acceptance of the revised Terms.

17. Plugin Installation & Data Exchange Consent

By installing, activating, or connecting any CrushPress.ai plugin or integration—including those designed for WordPress, HighLevel, Wix, Duda, Editor X, or any other supported platform—you expressly consent to the secure exchange of certain limited data between your connected platform and CrushPress.ai’s systems. This data may include, but is not limited to:

• Basic account identifiers (such as site domain, administrator email, and platform ID);
• Non-sensitive user information (such as role, display name, or permissions relevant to plugin operation);
• Content metadata such as post, page, schema, or SEO information required for optimization or synchronization.

This exchange of data is integral to the functionality and performance of the Service. By installing or enabling a plugin, you acknowledge and consent that such data transmission is essential to plugin operation and constitutes lawful processing based on user consent and legitimate interest. You may withdraw consent at any time by disabling or uninstalling the plugin; however, doing so may render certain Service features inoperable.

CrushPress.ai shall handle all transmitted data in accordance with its Privacy Policy and applicable data-protection laws, including GDPR, PIPEDA, and CCPA where relevant.
